1. Eligibility & Registration

You must be above 18 years and be able to enter into a binding contract to enjoy our services.
Companies should provide compliant KYC documents and successful onboarding prior to activation.
You are agreeing to give proper, accurate, and current information during registration.

2. Services Offered

Brainypay offers electronic payment solutions which include:

Online payment gateway integration
Merchant account creation and verification
Safe APIs and dashboard utilities
Real-time processing and settlement of transactions

We can change any feature at whim and with or without notice, suspend, or close it down.

3. User Responsibilities

You agree and acknowledge:
By using our services,

Keep your API keys, logon credentials, and account data secret.
Use our services only for legitimate business purposes.
Avoid fictitious, unauthorized, and illicit use, i.e., money laundering or illicit transactions.
Inform us immediately if there has been a breach of security or unauthorized access.

4. Compliance & Verification

You consent to Brainypay verifying your business and identity information with third-party payment service providers, banks, and regulators.

We are fully compliant with all applicable rules, e.g., tax, data protection, and anti-money laundering (AML).

Non-compliance will lead to account suspension or closure.

5. Fees & Settlements

Charges, fee, or commission due will be notified onboarding or through merchant dashboard.

Settlements will be made in accordance with our service agreement timelines subject to regulatory and bank requirements.

Fraud or breach of our terms suspected, Brainypay reserves the right to suspend or delay settlements.

6. Data Privacy and Security

Your data is secure, through encryption, firewalls, and other standard security practices in our line of business.
Our Privacy Policy addresses processing of your business and personal information.

You are responsible for securing and keeping your systems whole in integrating.

7. Suspension & Termination

Brainypay reserves the right to suspend or close your account where:

You break these Terms or our rules
Abnormal or criminal behavior is detected
There is a need to comply by laws or regulations
You are able to close your account with our customer care, on all arrears and liabilities following payment.

8. Limitation of Liability

Brainypay will not be liable for:

Indirect, incidental, or consequential damages
Loss of profits, data, or revenues
Delays or interruptions due to bank networks or third-party service providers
Our maximum liability will be the sum paid by you to Brainypay during the previous 3 months.

9. Intellectual Property

All design, software, and branding on this website belong to Brainypay or our licensors. You are not permitted to copy, use, or adapt our intellectual property before acquiring a prior written consent from Brainypay.

10. Governing Law & Jurisdiction

These Terms shall be interpreted, construed and governed according to the laws of [Insert Governing Jurisdiction, e.g., India]. Disputes shall be resolved by the exclusive jurisdiction of courts of Chennai
